Terms of Sale 2008

1) PAYMENT: Payment must be made in full by PayPal, money order, MasterCard, Visa, American Express, or approved check. We prefer PayPal on all internet bids. This payment must be made in full the day of the auction. Absentee and internet bidders have 1 week to pay for their items. Absentee and internet bidders after the auction will be contacted as the high bidder with-in 48 hours with payment directions. If payment is not received with-in 10 days you will be held responsible for the buyer’s premium, and any storage & handling fee’s that might occur with these items. A 13% Buyer's Premium is added to the final bid price of all items sold at the auction house. A 20% Buyer's Premium is added to the final bid price of all items sold to internet bidders bidding on ebay only. A 7% NJ Sales tax will also be charged to NJ residents, unless you have filed the appropriate resale certificate that indicates you are in the antiques and re-sale business. This form must be signed by the owner. Bodnar's Auctions has the right to hold merchandise until a check clears our bank.

 

Registration Requirements: You must have some form of ID to register to bid at our auction. Required form of ID is a Valid Driver’s License, Passport, Residence photo ID. We will not take a check for payment without a credit card number we hold in a secure file. If you do not have a credit card on file with us you will be on a cash or credit card only payment policy. We will not take starter bank checks as payment.  To receive a bidder paddle to bid a $5.00 refundable deposit is required.



2) CONDITION OF ITEMS SOLD: We do guarantee all items in our catalog portion of the sale as well as all fine jewelry for 48 hours once you receive the item for accuracy in the description. All other items sold at Bodnar’s Auctions are sold as-is, where-is, you the buyer know it to be with no refunds, no returns and no exchanges. Purchasers should take advantage of inspection opportunities to satisfy any questions they might have as to the condition, age, repairs, etc. of any item being offered. All sales are final. Measurements are all estimated not exact. We sell antiques, items that have been loved and used, we try to accurately describe any defects, however normal ware is to be expected and not described in the description. Bodnar's Auctions is not responsible for missing pieces of toys and games not obvious without directions or knowledge of the toy or game. It must be understood that we cannot be responsible for minor age defects or hidden conditions. They will be sold in an "as is" condition. Original boxes were used to protect the items inside, so they are usually worn. The original box is not included in the grading of the toys. It should be assumed that none of the toys are in working condition unless noted mint in working order in the description. All appliances are to be assumed not to be in working order. We handle many estate items and personal property thus we sell antiques, collectibles, new and old item as well as reproductions, It is the sole responsibility of the buyer to make their own judgment how old an item is that is not in a catalog setting.  

3) CLAIMS: No Claims will be allowed 48 hours after receipt of item.


4) RETURNED CHECKS: If your check is returned for NSF you will be notified immediately. A $50 fee will be issued and we will process your credit card on file with us. If you credit card is declined and the check is still NSF it will be handed over to the Franklin Township Police Department and the case will go to the prosecutor’s office in Somerset County.

5) SHIPPING: Local delivery is also available within a 60-mile radius of Somerset, NJ, local delivery fee is $125 in state or $175 out of state, and combined delivery is available on multiple purchases. Items can also be picked up in Somerset, NJ by appointment.


6) BIDDING: If you are the high bidder at the fall of the hammer you will be held responsible for that purchase. You will be in a binding contract and expected to pay for that purchase. It is highly recommended that once you receive your item you secure it either in a safe place inside the building or take it to your car. Once it is hammered down to your bidding number it will become your responsibility to secure this item.

7) Bidding on any item indicates your acceptance of these terms and conditions of the sale.

8) Due to the sensitive nature of clocks and watches they are all to be assumed not to be in working order unless noted in the description otherwise.

9) In the event in a refund for any reason, we will refund the purchase price only, shipping costs and buyer's Premium excluded.

10) Discrepancies of description shall be decided by mutually agreed upon experts in the field. An USPAP Certified written appraisal would be accepted. The authentication must be in writing and is at the expense of the purchaser.


11) If you buy an over sized item and it needs to be picked up by yourself or an outside shipping company, it must be out of our warehouse by our next auction sale date. If it is not picked up after this sale a $50.00 a week storage fee will begin to apply. After 16 weeks the item or items will become property of Bodnar's Auctions with no refund!

 

11) Please beware that you are on video tape at the sale. If you are caught stealing you will be arrested and prosecuted to the fullest extent of the law. If you did not buy the item do not take the item for there is nothing free at the event.

 

12) In the event of a bid coming in at the fall of the hammer, it could be re-opened at the sole discrepancy of the auctioneer.
